Privacy Statement.
Personal Information. When you register to use this Site, you must provide the Site with the following information: Your full name, credit/debit card billing address, city, state, zip code, phone number, email address and a credit/debit card holder name, number, expiration date and CCV. We use your Personal Information only to bill your credit card for the Registration Fee, notary bonds, errors and omissions insurance and notary supplies, and to communicate with you about service-related issues. Once all the required Personal Information is entered and processed, the you will be required to select a user identification and password that will enable you to access the Site and utilize the Site contents. ANP currently utilized a GoDaddy.com shopping cart which is a Level 1 PCI Service Provider.
ANP will access a Registered User's Personal Information only on an "as needed" basis and solely to provide services in connection with this Site. ANP will take commercially reasonable steps to keep such information confidential. ANP will not share any such Personal Information with any third party without your consent, except in the following circumstances: (a) in response to subpoenas, court orders or legal process, to the extent permitted and as restricted by law; or (b) when disclosure is required to maintain security and integrity of the Site, or to protect any Site user's security or the security of other persons, consistent with applicable laws. Non-personal information and data may be aggregated for statistical use by ANP and shared with third parties.
Terms of Use.
Use. You agree to pay a notary course Registration Fee as set forth within the Site in order to access and utilize the Site. Once ANP has successfully processed your Personal Information, Registration Fee, user identification and password, you will be designated as a Registered User and assigned a User ID number that is valid for the time period specified herein and for the issuance of one Proof of Completion certificate. As a Registered User, you are entitled to access and use the Site for a 365 consecutive-day period starting with the day your registration is processed. Your Registration is personal to you, you agree not to assign, transfer, resell or sublicense your rights as a Registered User unless specifically allowed by ANP. You agree that as a Registered User you are solely responsible and liable for any and all breaches of the terms and conditions of this Agreement, whether such breach results from your use of the Site or by another using your computer. You agree to contact ANP immediately if your password has been compromised or if you become aware of any unauthorized use or access to this site. You agree that ANP may modify the Site at any time, for any reason, and without providing notice of such modification to you. You further acknowledge and understand that (a) the official California Notary Public exam is not currently offered online or on any website (b) ANP works with CPS Human Resource Services to have the official California Notary Public exam administered after each of our live seminars in the San Diego area and (c) you must contact CPS Human Resource Services (www.cps.ca.gov) to schedule an official Notary Public exam date and time if you do not attend one of the state exams offered after one of our live classes in San Diego. You further agree and undestand that CPS requires a minimum number of candidates for each exam and all that seminar dates subject to cancellation or rescheduling in the event the minimum number of exam candidates is not met. Upon completed of the required course of study, each Registered User for the online and self-study courses must provide ANP with a signed Declaration Statement. Upon receipt of your signed Declaration Statement, ANP will issue a Proof of Completion certificate to the Registered User. Live class Registered Users will be issued a Proof of Completion certificate upon successful completion of the class. Only one Proof of Completion certificate will be issued to each Registered User for each User ID. Unauthorized users will be deleted from the database.
Refund Policy. All notary course fees Registration fees are non-refundable. If you are a Registered User for one of ANP's live notary course and do not pass the official California state notary public exam, you may retake one of our live classes a second time for free. You are responsible for all notary application and exam fees payable to Secretary of State. You are responsible for all FBI, DOJ And rolling fees for live scan fingerprinting services. Live scan fees are non-cancellable and non-refundable once the live scan has been completed. There is a $20 cancellation fee for all cancelled live scan services. This cancellation is in addition to any other cancellation fees. Online, Self-Study and Signing Agent notary course Registered Users: You agree that once you have registered, you are deemed to have accessed the site and you will not be entitled to a refund for any reason whatsoever.
Seminar Registered Users. You acknowledge that if you have registered to attend an ANP seminar, your seminar registration fee includes access to the site. You hereby agree to be bound by terms stated herein with regard to site usage and refund policies, and acknowledge that your seminar notary course Registration Fee is non-refundable except for that as stated above in the Refund Policy section. ANP makes every effort to accomodate our Seminar Registered Users with regard to seminar attendance and date selection. In the event that a Seminar Register User cannot attend the date for which he originally registered, ANP will allow the registrant to select a new seminar date at no cost, except as stated on special discount offers.
Supplies. There is a $25 cancellation fee on all cancelled notary bond, Errors and Omissions insurance, and/or notary supplies orders. This cancellation fee is in addition to the live scan service cancellation fee. Some orders are non-cancellable and non-refundable as stated herein. Supplies are normally mailed via USPS Priority Mail. If you have provided an email address during the registration process, a USPS tracking notice will be sent to the email provided. ANP is not responsible for lost, stolen or misdirected mail; however, all items shipped via USPS Priority Mail are covered for $50 by USPS insurance.
Notary journals. We purchase notary journals and thumbprint pads from Notary Rotary for resale. We do not make our own journal.
Notary seals - stamps and embossers. If you have ordered a notary seal, you must mail to ANP the ORIGINAL "Certificate of Authorization to Manufacture Notary Public Seals" form (aka seal certificate) that you received in your commission package from the Secretary of State.

We recommend that you email or fax the seal certificate to us before you mail it so that we can start working on your order. However, we need to stamp that original seal certificate before we can send the seal to you. If you are going to send your seal certificate to us via USPS priority mail or certified mail and you request "signature verification" from us, you are advised that this may delay your order for up to 5 business days.
Seals are processed promptly upon receipt of the copy of your notary commission or seal certificate. Seals are non-cancellable and non-refundable once you fax, email or mail the seal certificate to us.
Surety bonds. Allstate Notary Preparation, Inc. dba Bluewater Surety Insurance Agency is a licensed California insurance agency #0F09630. If you have ordered a notary bond and/or errors and omissions insurance policy, you must fax, email, or mail us a copy of your notary commission or your seal certificate so that we can process your notary bond or errors and omissions insurance. Notary bonds and notary errors and omissions insurance policies are issued promptly upon receipt of the copy of your notary commission or seal certificate. Notary bonds and notary errors and omissions insurance are non-cancellable and non-refundable once they have been issued. There is no fee to have your notary bond or notary errors and omissions insurance policy amended if you change your commission name. You must provide us with a copy of your amended notary public commission in order for us to amend your bond. We can only amend bonds and errors and omissions insurance policies that we originally issued. Amended bonds and amended errors and omissions policies will be mailed to you via USPS first class mail.
INDEMNITY AGREEMENT This Agreement entered into by and between the undersigned application or applicants and/or indemnitors, herein called the undersigned, and Merchants Bonding Company (Mutual), of Des Moines, Iowa, hereinafter called the Company, witnesseth: The undersigned certifies that the foregoing statements and declarations are true and, in consideration of the Company executing as surety the herein bond applied for, does hereby promise and agree to pay an annual premium to the Company until such time as the undersigned shall furnish the Company with evidence satisfactory to it of the complete termination of its liability on said bond. The undersigned further agrees to indemnify and save harmless the said Company, in connection with any bond executed on behalf of the person or entity named as applicant, for, from and against any and all losses, costs, damages, and expenses of any nature whatsoever, including counsel fees and expenses, and reimburse said Company for loss adjusting expenses and compensation at the rate of $100.00 per day for officers and $50.00 per day for all other personnel, which may accrue to the said Company by reason of the said Company having become surety on said bonds. The undersigned hereby further agrees that the vouchers or other evidence of payments made by the said Company under its obligation of suretyship shall be conclusive evidence against the undersigned of the fact and extent of the undersigned's liability to the said Company under said obligation of the undersigned, whether said payments were made to discharge a penalty thereunder, incurred in the investigation of a claim made thereon or adjusting a loss or claim in connection therewith, or in completing the work covered thereby, and whether voluntarily made or paid after suit and judgment against said Company. If the Company shall set up a reserve to cover any claim, suit or judgment under any such bonds, the undersigned will, immediately upon demand, deposit with the Company a sum of money equal to such reserve, such sum to be held by the Company as collateral security on such bonds, and such sum and any other money or property which shall have been, or shall hereafter be, pledged as collateral security on any such bond shall, unless otherwise agreed in writing by the Company, be available, in the discretion of the Company, as collateral security on any other bonds coming within the scope of the Agreement. The Agreement shall constitute a Security Agreement of the Company and also a Financing Statement, both in accordance with the provisions of the Uniform Commercial Code of every jurisdiction wherein such Code is in effect. This Agreement shall, if recorded, constitute a consensual lien upon any and all real estate owned by the undersigned a the time or such recording. However, the filing or recording of this Agreement shall be solely at the option of the Company, and the failure to do so shall not release or impair any of the obligations of the undersigned under the Agreement or otherwise arising, nor shall such failure be in any manner in derogation of the right of the Company under this Agreement or otherwise. The user of the Agreement as a Security Agreement, Financing Statement or consensual lien shall in no way abrogate, restrict or limit the rights of the Company under the Agreement or at law or in equity. The undersigned waive all right to claim any property, including homestead, as exempt from levy, execution, sale or other legal process. It is further agreed that the terms and conditions of the application shall also apply to increases and/or decreases in the amounts of any and all bonds, and shall also apply to all renewals whether the bond is continuous, renewed by Continuation Certificate or by the filing of a new bond. The Company shall have the right, and is hereby authorized, but not required to fill up any blanks left herein, and to correct any errors in the description of any of said bonds, or in said premium or premiums, or in any name or names, it being agreed that such insertion or corrections, when so made, shall be prima facie correct. This application shall be liberally construed so as to fully protect and indemnify the Company, its successors, assigneds and reinsurers. The undersigned appoints any officer of the Company as the attorney-in-fact of the undersigned with full right to execute on behalf of the undersigned any document necessary to carry into effect the intent and purposes of this Agreement. A facsimile copy of this document or the signature(s) thereon, shall be deemed to be an original and/or original signature(s) for all purposes. NOTICE: In requesting a bond from Merchants Bonding Company (Mutual) you are hereby notified the Company may request a consumer credit report for all applicants for underwriting purposes.
When you place an order for a notary bond or notary errors and omissions insurance with Allstate Notary Preparation, Inc. dba Bluewater Surety Insurance Agency you agree to the terms of the indemnity agreement stated herein.
Security. We secure the Personal Information we maintain about our Registered Users on computer servers in an appropriately controlled, secure environment, protected from unauthorized access, use or disclosure. We also use encryption technology when collecting sensitive information such as a credit card number. While we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from illegally obtaining this information. Given the inherent operation and structure of the Internet, you agree that all transmissions are done at your own risk.
Cookies. The use of cookies is common in the Internet industry. "Cookies" are small data files sent to your browser and stored on your hard drive. We may use cookies to personalize content, control security, measure traffic patterns and collect information on Internet usage. These files do not collect Personal Information about you. Rather, they operate by identifying your browser, saving information regarding your use of a Web site, and providing you with personalized services.
IP Addresses. An IP address is a number automatically assigned to your computer by your Internet service provider. This Site may collect IP addresses, the associated URLs, domain types, the browser type used to access the Site, the country, state and telephone area code where the users' Internet service provider's servers are located, the pages of this Site that users viewed during their visit and any search terms entered on the Site. Collection of IP addresses is generally for system administration purposes, to gather broad demographic information, to monitor the level of activity on the Site and for security reasons. Personal Information may be linked to IP addresses to protect the security or integrity of the Site.
Disclaimer of Warranties and Limitation of Liability. The Site is provided to each Registered User "as is" without warranty of any kind. Neither ANP nor any of its suppliers or licensors, employees or agents warrant the service will be uninterrupted or error free or free from viruses or other harmful malicious agents. ANP does not warrant that any data or any files sent by or to you will be transmitted in uncorrupted form or within a reasonable period of time. All representations and warranties of any kind, express or implied, including, without limitation, any warranties of title, non-infringement, fitness for a particular purpose and merchantability are hereby excluded and disclaimed. In any event, ANP's cumulative liability to you for any and all claims relating to the use of the site shall not exceed the total amount of registration fees paid during the immediately preceding 60 day period. You hereby release ANP from any and all obligations, liabilities, and claims in excess of this limitation. ANP is also not liable for any costs or damages arising from or related to your breach of this agreement. Your sole and exclusive remedy under this Agreement are as expressly set forth herein. Some states do not allow the exclusion or limitation of implied warranties, so the above exclusions or limitations may not apply to you.
Ownership. This Site is owned and operated by Allstate Notary Preparation, Inc. The Site contains intellectual property protected under United States copyright laws, international treaty provisions, and other laws. All right, title, and interest in and to the Site, including associated intellectual property rights, are and shall remain with Allstate Notary Preparation. As a Registered User, you agree to comply with the terms and conditions of this agreement in connection with the Site. Entire Agreement. This Agreement constitutes the entire agreement and understanding between the parties with respect to its subject matter and supersedes and replaces any and all prior written or oral agreements. In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of its provisions shall remain in full force and effect. Nothing contained in this Agreement shall be construed to limit ANP's rights and remedies available at law or in equity. ANP's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. This Agreement may not be assigned or transferred by you, the Registered User. This Agreement is freely assignable by ANP to third parties.
